Senator Roxas to Ombudsman Merceditas Gutierrez: What accomplishments?

Liberal Party President Senator Mar Roxas today rebuked Ombudsman Merceditas Gutierrez for claiming much has been done to fight corruption amid action from international agencies and even the US government that have expressed alarm over the spread of corruption in the Philippines.
"Nasa'n ang sinasabi niyang accomplishments? Wala akong nakikita (Where are the accomplishments she is claiming? I don't see any)," he said in reaction to Gutierrez's claim before members of the Rotary Club of Manila on Thursday that her office had overseen the disposition of a record number of cases, and had seen the prosecution and conviction of high government officials.
He said what is more apparent to the public is the Ombudsman's cover-up of corruption involving President Gloria Macapagal-Arroyo's men involved in cases like the NBN-ZTE bribery scandal, the DA fertilizer fund diversion scam, the Euro Generals international controversy and the World Bank collusive bidding allegations.
"Anong sinasabi niyang sterling performance ng Ombdusman? Inupuan niya ang mga kaso, nagkalumot na ang mga ito sa opisina niya, napanis na ang mga ito. 'Yan lang ang ginawa niya (What sterling performance is she talking about? She sat on the cases until these grew cobwebs, until they got stale. That's what she did)," he stressed.
He said Gutierrez's inaction on cases involving officials close to GMA has prompted an impeachment complaint to be filed against her with the House of Representatives.
"Sa tagal ng pagkilos niya sa mga kaso laban sa mga alipores ng pamahalaang ito, nawala na ang mga witnesses na maaari sanang magdiin sa mga kawatan sa gobyerno. Nakalimutan na nga ng publiko ang mga kasong ito dahil sobrang tagal na silang nakabinbin sa opisina niya (Because of her slow action on complaints against allies of this government, many of the witnesses who could have nailed down the culprits have already disappeared. The public has forgotten these cases because they have long been placed in the backburner)," he added.

Ka Jovy Salonga and Mar Roxas are conspirators

Here's a statement of the Liberal Party of the Philippines in admitting that Ka Jovy Salonga and LP President Senator Mar Roxas are consipirators.
In supporting the impeachment complaint against Ombudsman Merceditas Gutierrez, we in the Liberal Party admit to be part of a conspiracy for good. Ka Jovy Salonga and Mar Roxas are its masterminds. We are engaged in a conspiracy for clean governance, a conspiracy against syndicated corruption in government.

We have waited so long for this showdown with Ombudsman Mercedita Gutierrez and her political masters. Punung-puno na kami at punung-puno na ang bayan. The nation is nauseated by the stench of corruption in this administration and we are determined to impeach its main promoter and protector.

When will we, Filipinos, act to fix corruption in our own land? It is a shame that we cannot clean up our own kitchen. It took the United States to arrest Jocjoc and General Garcia’s sons. It took Russia to intercept the Euro Generals. It took the World Bank to expose anomalous road contracts.

If Gutierrez is not impeached, the Philippines will graduate from the most corrupt nation in Asia to the most corrupt in the world.

And where was the Ombudsman when all of these cases were happening? She was making sure that the evil schemes of the administration were kept in the shadows and out of public scrutiny—under a modus operandi of delay, distract, cover up, obfuscate and confuse. She was coddling grafters and keeping them from the reach of justice.

We are resolved to attack this syndicate of corruption and expose it in the full light of truth. We know that many in the legislature share our cause, especially those who have been blackmailed and intimidated by the administration to toe the line or else be whimsically investigated by the notorious Ombudsman. We ask them to stand and be counted.

We stand beside Ka Jovy Salonga and our allies. We are proud of their actions in behalf of our people. We further condemn Ombudsman Merceditas Gutierrez for her malicious remarks against Ka Jovy and demand that she act and speaks under the high standards of decency and civility that inures to her Office

Senator Roxas: GMA must stop corruption, misuse of power now

Liberal President Senator Mar Roxas today said President Arroyo must now stop corruption in her administration and give up efforts to stay in power beyond 2010 or face the wrath of a people fed up with graft-tainted controversies and the blatant misuse of power of government officials.
"I warn the present administration about the clear signals of a systems' failure in almost several fronts of governance. The plunderers are not being put in jail. The hungry are not being served. The victims of social and criminal injustice are not being given their due. The nation is extremely dissatisfied with the national management and leadership because the people see power being exercised not to their interest but to the interest of a chosen few," he said as he recalled the circumstances that led to the first EDSA people power.
He said with President Arroyo seemingly ignoring corruption scandals swamping her administration and her allies pursuing constitutional amendments to lift term limits, the activist attitude within Filipinos are being silently stirred into action, a situation which he said could become uncontrollable because of the "incessant and seemingly insurmountable ailment of corruption and the misuse of power."
"The biggest cause of military adventurism is the plunder of the people's money by those in power combined by brazen attempts to perpetuate themselves beyond the limits of the Constitution," he said, noting that, "today, observers here and abroad have already labeled our nation as a failing democracy. The scandals are rife in the midst of an economic crisis crying out for the full and undistracted attention of government. Hunger mounts and crime is up. Peace is not at hand," he pointed out.

"President Arroyo has no more time to wait. She must cut corruption and renounce perpetuation in power with decisive acts and clear words. As in the months leading to February 1986, she must not court adventurism from those who hold the monopoly of force in our society," he stressed.
The Ilonggo senator said that with government systems beginning to show signs of failing, similar to the country's situation months and years before the 1986 uprising, "the next stage is the collapse of institutions. When institutions collapse, the entire Republic follows."
"Nevertheless, I have high hopes that our democracy is secure, mainly because the Filipino people have so much faith in it, because they have proven so many times in the past that they will never sacrifice democracy in the altar of expediency and self-serving gain," he said.

"On this day in 1986, the Filipino people won against dictatorship owing largely to the valiant stand of the Armed Forces of the Philippines. The young officers at the helm of the EDSA revolution were daring and selfless. We extol them today not because we believe that martial adventurism is a cure to a ruined democracy, but because we believe that even at the darkest moments when all hope seems lost for freedom, there are valiant Filipinos who are willing to lay down life and honor to preserve it."

Senator Roxas to PGMA: Order probe of FG Mike

Liberal President Senator Mar Roxas today stressed President Gloria Macapagal-Arroyo should now act to save the country's "corrupt" image in the international political arena, and she can begin by ordering an independent investigation into the numerous anomalies involving her husband, First Gentleman Mike Arroyo.
"Mahalagang linisin natin ang imahe ng ating bayan. Nakakahiya na tayo sa buong mundo. Ang tingin nila ay puro korap ang mga opisyal natin. Kailan pa ba kikilos si GMA? (It is important to clean our country's image. We are really in a very embarrassing situation now. The world thinks all Philippine government officials are corrupt. When will GMA act to stop this?)" he asked.
He said the president can prove her sincerity in removing corruption by subjecting her husband to an independent investigation and by allowing the long arms of the law to be served on him, when he is found guilty of pocketing millions of pesos in bribe monies and for masterminding multi-million peso fund diversion scams.

He also said President Arroyo should not ignore testimonies given to World Bank investigators that her husband and an unnamed former senator received millions of pesos in bribe monies in exchange for favorable endorsements to local and foreign contractors for them to be able to bag infrastructure contracts with the government, particularly the Department of Public Works and Highways.

The WB had conducted an investigation into irregularities that tainted projects that it financed in the country. As a result of the probe, seven firms - three from the Philippines and four from China - were banned from participating in any WB-funded projects here after they were found to have engaged in "collusive practices" in the bidding of a road project.
"Hindi pa ba sapat na ang WB na mismo ang nakakuha ng testimonya na milyong-milyong piso ang ibinayad ng mga kontratista kay Mike Arroyo para lamang manalo sa bidding ng mga projects sa DPWH? Kailangang kumilos na si GMA ngayon na (Isn't it enough that no less than the WB has been given testimonies that contractors had to pay millions of pesos to Mike Arroyo to get government contracts? She should act now)," he stressed.

"Gloria should make a clear statement that her husband is not beyond the law. She should not use her position to influence the findings of any investigating body. And if her husband is found guilty of any of the allegations against him, then she should not think twice about him going behind bars for his corrupt acts" he added.
Roxas warned the WB findings could affect relations between the Philippines and the United States, especially following the anti-corruption pledge that new US President Barack Obama made during his inauguration last month.

Also, the Ilonggo senator said it was not a surprise that the Philippines has been lumped with Nigeria, Pakistan and Bangladesh as among the nations with failing democracies due to rampant corruption in government.

He said controversies like the NBN-ZTE bribery, the P728 million fertilizer fund diversion, the "Euro Generals" money laundering and the most recent, the collusion between the owner of the Legacy Group of Companies and the Securities and Exchange Commission (SEC) to rip off hundreds of pre-need plan holders and bank depositors of their hard-earned savings have left an impression of widespread corruption in the nation.
"She should act to clean up the graft gangs in her government. She must spearhead this war against corruption by starting in her own backyard. Only then can she prove her sincerity," he said.

No to a "Gloria Forever Constitution"!

The Arroyo Administration has alienated most of the nation because of its failure to live up to its social contract with the Filipino people to provide the country with good governance, Liberal President Senator Mar Roxas said this week.

And forcing the people to accept a “Gloria Forever Constitution” will backfire and condemn the Arroyo Administration as history’s most power-hungry and inept government, Roxas warned in a speech during the week before the Private Hospitals Association of the Philippines.

This is the reason why Filipinos eagerly await the elections in 2010 rather than the impending Charter Change moves in Congress by President Arroyo’s allies who want a “Gloria Forever Constitution,” Roxas said.
“We have a social contract … However, that contract is now broken. Napunit na ang kasunduang iyon. That social contract is so broken that is why so many of our kababayans feel alienated from general society and from their government, that is why so many of our youth feel detached from what is happening here in our country,” he added.
He said that instead of engaging in programs to cater to the “real” needs of the people, “the government is busy being corrupt.”
Roxas also bewailed the government’s failure to prepare for the effects of the US-led global financial meltdown, which is slowly creeping into the Asian economy.
“What is our government doing in the midst of this? Nothing. It is fixated on Chacha. So we wonder, how come the trust ratings of the government and of the leaders are so low? It’s because we have problems and yet those that have been given power to address and fix these problems are not doing so,” he added.
The Ilonggo senator said Filipinos could contribute in reforming the government by participating in the 2010 national elections.

He said voters should choose someone who has a good track record, someone sincerely interested in helping the people, and someone who has a vision for the country.
“Sa darating na halalan, may pagkakataon ang sambayanan na mamili ng tamang lider. Ang lider na tapat, matuwid, ang lider na hindi mangungurakot, ang lider na may plano para sa ating bansa at ang may kakayahan para isakatuparan ang plano na iyon. Iyan ang kagandahan ng demokrasya kasi masama man ang sitwasyon natin pero regular tayo nabibigyan ng pagkakataon na mamili ng bago,” he said.

Roxas: Esperat decision start of Ombudsman cover-up

Liberal President Senator Mar Roxas rebuked Ombudsman Merceditas Gutierrez Saturday for dismissing the graft charges filed against former DA Undersecretary Jocelyn “Jocjoc” Bolante by slain journalist Marlene Esperat in 2003, as he expressed concern this could be the start of an official whitewash of the anomalies in the agriculture sector in the Arroyo Administration.
“Ang kapalit ng pagtataksil na ito ay ang buhay ni Esperat (The price for this betrayal is Esperat’s life),” Roxas said regarding the Ombudsman’s decision this week to junk the graft charges filed by Esperat in 2003 against Bolante, Agriculture Secretary Arthur Yap and other DA officials in relation to a P432-million fertilizer fund that never reached farmer-beneficiaries.
He said Gutierrez has proven again public perceptions she has become a willing tool of Malacañang to cover up irregularities in the Arroyo Administration, adding he is concerned the Ombudsman will likely throw out the plunder charges against Bolante and other Arroyo officials involved in the P728-million fertilizer fund scam in 2004.
“By junking the Esperat case, Ombudsman Gutierrez has again betrayed her constitutional duty to protect the people. Do we need more lives to be sacrificed before the corruption in this administration is brought to justice?” Roxas asked.
The Ilonggo senator has warned that Ombudsman Gutierrez’ inaction on major graft cases involving officials close to the First Family and their allies will intensify calls for leadership change in the government similar to the call made recently by five bishops led by CBCP President Archbishop Angel Lagdameo.

He expressed concern that the Ombudsman found no reason to prosecute those involved in the fund diversion despite Esperat’s sacrifice of her life.

Esperat was a former journalist who filed graft charges as resident Ombudsman of the DA’s Central Mindanao office against Yap, Bolante and other DA officials for their alleged involvement in a P432-million fertilizer fund diversion scheme in 2003. She was gunned down before her children in their home in Sultan Kudarat.
“Ang mensahe nito sa ating lahat ay wala na tayong aasahan pang hustisya sa ilalim ng administrasyon na ito (The message here is that we should not expect justice under this administration),” Roxas said.

Roxas seeks US agencies' aid in recovering fertilizer funds

Liberal President Senator Mar Roxas today sought the assistance of various US government agencies in recovering the P728-million fertilizer fund or parts of it believed to have been deposited in bank accounts and assets of former Agriculture Undersecretary Jocelyn “Joc-Joc” Bolante in the United States.

In separate letters to three US agencies involved in finding illicit funds, the Roxas asked “for an exhaustive and comprehensive financial investigation” on Bolante’s bank accounts and assets in the US in line with the principles of truth and accountability in public offices.
“Sa pagdulog ko sa mga ahensiya ng Estados Unidos, kampante akong hindi nila papalampasin ang ganito kabigat na krimen,” he said.
He addressed this appeal for assistance to, among others, Stuart Levey, Undersecretary, Office of Terrorism and Financial Intelligence, Department of Treasury; Mark Sullivan, Director, Financial Crimes Division, Secret Service; and Matthew Friedrich, Acting Assistant Attorney-General, Asset Forfeiture and Money Laundering Section, Criminal Division, Department of Justice.
“Ginagawa natin ang lahat para maibalik dito si Joc-Joc para harapin niya ang batas sa lalong madaling panahon. Apat na taon na nating hinihintay ito. Kailangan nating ipakita na walang taong makakalusot sa krimen laban sa mamamayang Pilipino,” said Roxas.
He noted in the letters that although Bolante’s 32 known bank accounts had already been frozen, “there is strong probability that a substantial amount of the missing public fund has already been deposited to foreign banks or otherwise used to acquire assets in the United States. I fear that the Filipino taxpayers’ money, which has been illegally diverted to other uses, will never be traced and recovered,” he said in the letters to the US agencies.
“Hindi biro ang halagang ito: P728 milyon na dapat sana’y napunta sa mga magsasaka. Hindi puwedeng mawala na lang ito na parang bula,” he said.
Roxas noted that the Senate, on March 1, 2006, had already released its report finding Bolante to be the “main architect” of the P728-million fertilizer fund scam, and recommended the filing of criminal charges against him.

The US Court of Appeals 7th Circuit has already dismissed Bolante’s petition for asylum in the US, and a final ruling affirming this is being awaited. Last September 18, Roxas wrote US Ambassador Kristie Kenney requesting for her assistance in ensuring Bolante’s deportation directly to the Philippines once the US courts rule with finality against the asylum petition.
