Roxas: Esperat decision start of Ombudsman cover-up

Liberal President Senator Mar Roxas rebuked Ombudsman Merceditas Gutierrez Saturday for dismissing the graft charges filed against former DA Undersecretary Jocelyn “Jocjoc” Bolante by slain journalist Marlene Esperat in 2003, as he expressed concern this could be the start of an official whitewash of the anomalies in the agriculture sector in the Arroyo Administration.

“Ang kapalit ng pagtataksil na ito ay ang buhay ni Esperat (The price for this betrayal is Esperat’s life),” Roxas said regarding the Ombudsman’s decision this week to junk the graft charges filed by Esperat in 2003 against Bolante, Agriculture Secretary Arthur Yap and other DA officials in relation to a P432-million fertilizer fund that never reached farmer-beneficiaries.

He said Gutierrez has proven again public perceptions she has become a willing tool of Malacañang to cover up irregularities in the Arroyo Administration, adding he is concerned the Ombudsman will likely throw out the plunder charges against Bolante and other Arroyo officials involved in the P728-million fertilizer fund scam in 2004.

“By junking the Esperat case, Ombudsman Gutierrez has again betrayed her constitutional duty to protect the people. Do we need more lives to be sacrificed before the corruption in this administration is brought to justice?” Roxas asked.

The Ilonggo senator has warned that Ombudsman Gutierrez’ inaction on major graft cases involving officials close to the First Family and their allies will intensify calls for leadership change in the government similar to the call made recently by five bishops led by CBCP President Archbishop Angel Lagdameo.

He expressed concern that the Ombudsman found no reason to prosecute those involved in the fund diversion despite Esperat’s sacrifice of her life.

Esperat was a former journalist who filed graft charges as resident Ombudsman of the DA’s Central Mindanao office against Yap, Bolante and other DA officials for their alleged involvement in a P432-million fertilizer fund diversion scheme in 2003. She was gunned down before her children in their home in Sultan Kudarat.

“Ang mensahe nito sa ating lahat ay wala na tayong aasahan pang hustisya sa ilalim ng administrasyon na ito (The message here is that we should not expect justice under this administration),” Roxas said.

Cotabato's SP supports Senator Roxas' draft bill

The draft Mindanao Land Conflict Settlement Commission of Senator Mar Roxas immediately garnered the full support of the members of the Sangguniang Panlalawigan of North Cotabato.

In Resolution No. 469, the North Cotabato legislators stated that the establishment of the commission is a concrete, culture-sensitive mechanism to address this problem (land dispute) and eventually pave the way for peaceful co-existence among Muslims, Christians and the Tribal people in Mindanao.

However, the SP members recommended an amendment to Section 8 of Senator Roxas bill which will establish the headquarters in Kidapawan City instead of Davao City.

Representatives Emmylou Mendoza and Bernardo Pinol. Jr of the first and second districts of Cotabato province respectively are requested to file similar bill in the lower house.

Roxas: Peace must be in line with the national interest

Peace can never happen when the country is torn into pieces.

In a meeting with the Catholic Bishops’ Conference of the Philippines today, Liberal President Senator Mar Roxas stressed that lasting peace in Mindanao must be pursued in line with the national interest and by a sincere government.

“Peace must be pursued in line with the universal interest of all Filipinos—whether Muslim, Christian or Lumad. Peace cannot happen with disunity, with a people partitioned according to race or belief,” he said.

“And this peace must be pursued by a government that rules with the consent of the governed, that gives all citizens equal protection under the law. But what has happened that lead to our quandary right now is due to a government that tends to fragment our nation rather than lead it to one common aspiration,” he added.

Roxas lamented that with its recent acts, the government has shown either gross incompetence or something else: a gross disregard for the common interest.

“This government has managed to divide and fragment our nation through the years, and now by bungling on the peace process with the MILF. Ineptness and impatience prevailed, and deception to all—Muslim, Christian or Lumad—was employed to pursue an invalid memorandum of agreement with the MILF,” he said.

“And the result: more than a hundred innocent lives lost and more than 200,000 evacuees struck by hunger and disease,” he stressed.

The government, Roxas said, must accept responsibility for its actions and bring the peace process back on track, following Constitutional standards and transparency.

“It must, first of all, bring all lawless elements to justice. All those who violate human rights and rule of law—be it MILF splinter groups or other vigilantes—must be brought to justice. The government must smother Mindanao with the rule of law,” he said.

“The MOA between the government and the MILF must be torn apart, and we want the Supreme Court to do so through a definitive decision so it will no longer be used as leverage in peace negotiations and diplomatic discourse. On the part of the government, it must revamp the peace panel now,” he added.

Roxas advised the government to implement the rule of law forcefully and equally, with no ethno-linguistic or religious prejudice. Else, the scenario of conflict will escalate when civilians start taking the law into their hands.

“If the government fails to strengthen its presence in Mindanao now, it will eventually have to go in between the crossfire of warring vigilantes,” he said.

Roxas to Mindanaoans: We are with you all the way

Senator Mar Roxas, Liberal President, said he will continue to defend the people of the Mindanao against the attempt of the government, through its peace panel, to break the country into two for vested interests.

"This is an issue that is affecting all Mindanaoans regardless of status or religion. I will do my all in my capacity as a Senator to protect our country's sovereignty and the interests of every Filipino," he said.

He met with Sultan Kudarat Gov. Teng Mangudadatu in the morning at the Provincial Capital; later, in the afternoon, he visited Tacurong City Mayor Lino Montilla and South Cotabato Gov. Daisy Fuentes, to discuss the controversial GRP-MILF Memorandum of Agreement, which has been held from implementation only through a Supreme Court temporary restraining order.

"I have spoken to the provincial and local leaders and I am confident that they will do all they can for their constituents. We will not be victims of this sellout of our people and our natural resources," he said.

"I speak on behalf of the Liberal Party which stands by the Mindanaoans during this time of conflict and uncertainty. We have brought our battle to the Supreme Court and in the Senate to get to the bottom of this MoA," he added.

Last week, Roxas was in North Cotabato and Zamboanga City with North Cotabato Vice-Governor Emmanuel Piñol and Zamboanga City Mayor Celso Lobregat, to discuss the issue. The three are among the petitioners in the Supreme Court case to prevent the GRP-MILF agreement from pushing through.

"We demand complete transparency regarding this agreement. I call upon the government to let the people know, completely and without qualification, its intentions and strategies concerning the situation in Mindanao," he said.

Senator Mar Roxas' Privilege Speech on the GRP-MILF MoA

Here's a summary of Senator Mar Roxas' privilege speech on the GRP-MILF Memorandum of Agreement provided by the Senator's office.

1. This MoA violates at least three major articles of our Constitution. Unang pahina pa lang, hindi na papasa ito sa Saligang Batas.

a. Rather than respect our national territory, this MoA breaks it up into smaller bits.

b. Rather than uphold the ideal that all government authority emanates from the people, this government entered into an agreement that would partition our country without prior consultations with the people of Mindanao.

c. Rather than uphold one sovereign people enjoying the equal protection of law, the MoA effectively splits the citizenry in two.

2. We had wanted peace and security achieved through these negotiations. Instead, we are on the brink of war. Government functionaries are making lame excuses for their bungling of a peace process that has spawned war rather than peace. None have spoken to stand by this MoA on the basis of reason and statesmanship; instead, its proponents have resorted to finger-pointing..

3. I demand complete transparency regarding this agreement. I call upon the government to step out from behind the veil of generalizations; to let the people know, completely and without qualification, its intentions and strategies concerning the situation in Mindanao.

4. I urge the government to enforce the equal protection of laws now. I call upon the President to revamp her entire peace team, including her peace adviser and peace panel. I call upon the Armed Forces to enforce order in accordance with the principles of the constitution. And I call upon all parties to the conflict to stand down and pave the way a renegotiation of the MOA.

5. More than anything else, I urge the government to do its utmost best to keep the nation whole. To keep the great ideals of our country: One territory, one sovereign people under the equal protection of the laws.

6. The answer is not in further shattering this ideal of one Philippine nation. And this has nothing to do with religion or ethnic boundaries. We are all for peace. The answer is in rebuilding our nation so that none feel neglected for the sake of others.

Hermogenes Esperon must resign - Roxas

In his statement yesterday, Senator Mar Roxas called on Mrs. Gloria Macapagal-Arroyo to remove (Ret.) General Hermogenes Esperon, Jr. as her adviser on the peace process. Here's the Senator's complete statement:

"Hinihingi ko kay Pangulong Arroyo na sibakin na si General Hermogenes Esperon bilang Presidential Adviser on the Peace Process. Ayon kay Vice Governor Manny Piñol, na kinausap ko kagabi, nagbanta si General Esperon kay Vice Governor Piñol na hindi na maaasahan ng mga kababayan natin sa Mindanao ang suporta ng ating mga sundalo, kung hindi nila tutulungan at susuportahan itong MOA na negotiate ng gobyerno sa MILF.

"Labag ito sa batas. Labag ito sa sinumpaang tungkulin ni General Esperon at tama lamang na sibakin ni Pangulong Arroyo si General Esperon sa kanyang tungkulin.

"Itong kasunduan na ito ay hindi nauunawaan ng ating mga kababayan. Nakita natin sa proseso na kulang sa konsultasyon at wala halos ang nakakaalam sa nilalaman nitong kasunduang ito. Ito ay pruweba sa maling stratehiya na ginamit ng pamahalaan sa pag-negotiate dito, isang stratehiya ng pagtatago sa katotohanan, at pamumuwersa o pambabraso ng mga maaapektuhan nito.

"Hindi ito ang pamamaraan para mag-negotiate ng isang peace agreement. Kailangan lahat ay nakakaalam ng nilalaman nito, at sumusuporta rito. Kung hindi, nasa papel lamang itong peace agreement, at yung kaguluhan ang siyang iiral pa rin."

Roxas to Exec: Ensure safety in ARMM polls

As there is “no material time” left for Congress to postpone the ARMM elections on August 11, Senator Mar Roxas said the administration, in coordination with the COMELEC, should instead focus on ensuring poll safety.

“There is no material time left. Eight days is not enough to pass a law. The administration should not even attempt to railroad this because it has given no clear and acceptable reasons for postponing the elections,” he said.

“Malacanang should focus instead on the most important concern -- ensure the safety of voters, candidates, teachers and other poll workers and volunteers, and, most importantly, protect public confidence in the new automated elections. Violence must not lead to a failure in the ARMM elections,” he added.

The Liberal Party President pointed out that the COMELEC has made substantial preparations for the ARMM polls, where the automated elections—a fundamental reform to democratic governance that Roxas consistently supported —will be pilot-tested.

“By railroading the postponement of the elections without even giving any viable reason, the administration is asking us to dispense with the ARMM voters’ Constitutional right to suffrage,” he said.

“What they’ve said so far is that the postponement is crucial in finally concluding the peace talks with the MILF. The Senate has yet to see anything that will justify this reason,” he added.

Roxas said the elections should push through regardless of the peace talks to strengthen ARMM voters’ belief in the electoral process. The credibility of elections in ARMM have always been doubted because of repeated incidents of goon politics, cheating, and violence against voters and poll workers, particularly public school teachers who man the election precincts.

He said the death of teacher Musa Dimasidsing in last years’ elections highlights the need to reclaim the credibility of elections in ARMM and in the country. Mr. Dimasidsing was shot to death by unidentified gunmen after exposing alleged poll fraud in Maguindanao.

Of the 121 persons killed nationwide in the 2007 polls, 63 (or 52% were classified as civilians and supporters, which include teachers. Of the 176 wounded, 116 were also of the same class. The 2004 polls was the most violent in recent years, when 148 of 189 (78% persons killed and 261 of 279 (94% persons wounded were supporters and civilians.

The Mar Roxas 2010 blogger with Cebu and Davao bloggers

Before the event, I was in Hidden Valley, that's in Lamac, Pinamungajan, Cebu for a Leadership Traning Workshop together with my friends. The name of the place speaks for itself. It's really a hidden wonder! It's very far from the highway and mostly motorcycles for commuting called "habal-habal" are frequent in the area. Supposedly, the event was slated for June 28-29 but I really need to attend the bloggers' meet-up as promised. So, I cut short my attendance to the event. I rode a "habal-habal" at 10:30 AM but as we went along the road going to Lutopan, Toledo City, the motorcycle stopped for 5 times because of engine problems. I was pissed off! I got wet and dirty because of that. Even though I still didn't reached the Lutopan terminal, they dropped me in the market, which was 500 meters away, and told me to ride another motorcycle. Grrr!! What made me even more angry was that, they let me paid P100 instead of the negotiated payment of only P60! Then, when I arrived in the terminal, I waited for almost 30 minutes inside a V-Hire that would bring me back to the city. After almost 1 hour of the trip (I even slept), I arrived in One Citi-Link Terminal (the area where these V-Hires settle), I immediately went to V. Rama Avenue to ride a 12-L jeepney which passes by Fuente Osmeña. When I embarked from the jeepney, I walked from G. Garcia Street to Bo's Coffee Club. It was still 1:40 PM though, so I took a rest.

I attended the most-awaited meet-up (which was very successful) of Cebu and Davao bloggers here in Cebu. The informal event, held at Bo's Coffee Club in front of Cebu Doctor's Hospital at 2 PM, was organized by two of Davao's prominent bloggers, namely Blogie Robillo and Winston Almendras. Winston, Mark Monta and yours truly had already met before in SM and talked about the status quo of the Cebu Bloggers' Society. Though yesterday, Mark texted me that he can't attend the event. The event was the second that I attended. The first was the one with Ma'am Janette Toral.

The attendees, Wilson Ng, Paul Winston Villacorta, Xerxes Bernadez, Max Limpag, Aldrin Ponce, Rio Calle, Aileen Estoquia, Wilhelmina Sarawi, Mark Abitona, Rodelio Lagahit, Francis Daniel Maning, were very happy that finally, the event would be the start in organizing the blogging community here in Cebu and later, in the entire Visayas hopefully. We had met each other and shared our blogging insights. It was a lively meet-up. I just hope that these event would be a habit for Cebuano bloggers just like the Davao bloggers. I am part of the team consolidating the Cebu bloggers to form an organization same as the successful Mindanao Bloggers, Inc.

I was quite happy that the my fellow bloggers are supportive of my cause though not directly saying that they're voting or not for Senator Mar Roxas if he enters the 2010 presidential derby. Sir Wilson even said that there's nothing wrong with having this kind of blog. Indeed, it's a new thing in the Philippine blogosphere. :)

Statement of Senator Mar Roxas on the release of Ces Drilon, Jimmy Encarnacion, Angel Valderama and peace advocate Octavio Dinampo from their captors

"We are very happy and relieved that TV journalist Ces Drilon, cameramen Jimmy Encarnacion and Angel Valderama as well as peace advocate Prof. Octavio Dinampo, are now safe and free from the clutches of their abductors."

"They have been through a harrowing experience from which they would need more time and privacy to recover from. Meanwhile, this incident must and should not be condoned. Our law enforcers must work closely with local officials to stamp out terrorism and banditry in Mindanao and bring its perpetrators before the bar of justice."

"This incident is but a symptom of a deep and systemic problem: decades of poverty and armed conflict in the South exacerbated by government's neglect. It is imperative that the executive branch start mobilizing its resources to help the people of Mindanao cope with rising prices, growing poverty, and widespread unemployment. An effective economic relief package for poor communities in conflict-areas in Mindanao would deter the build-up of terrorist forces in the region."

Roxas to PGMA: "Save the Republic"

Davao City – Senator Mar Roxas on Wednesday made a call to the President to “save the Republic,” in light of controversies arising from the anomalous government contract with ZTE Corp. for a National Broadband Network.

At the sidelines of the League of Municipalities of the Philippines’ Mindanao Island Cluster Congress, Roxas outlined to reporters his proposed steps that the President could take relative to controversies hounding her administration.

“My recommendation to the President would be to save the Republic, to save the instutution of the Presidency, to save our country from Constitutional crisis, by doing the following:

“First, to lift EO 464; Second, to instruct all her cabinet officials and police officials to attend all investigations not just the Senate’s but also the Department of Justice and the Ombudsman, so they can tell everybody kung ano talaga ang nangyari rito;

“Third, to suspend such officials who do not follow this; Fourth, to instruct the National Economic and Development Authority to release to the Senate the all documents relative to the NEDA hearings on the ZTE contract.”

Asked by reporters to describe the country at present, Roxas, president of the Liberal Party, said it is “broken.” “Our country is broken. The institutions have low credibility. The executive itself has low respect from the people. And we need to fix this. Ang ating mga kababayan, yung tiwala nila sa ating pamahalaan, sa ating mag opisyales ay mababang-mababa na o kaya wala na,” he said.

“Kaya magagamot lamang natin ito, aayos lamang ang ating bansa kung maibalik natin ang tiwala ng ating mga kababayan sa kanilang pamahalaan sa pamamagitan ng tuwid at tapat na pang-gogobyerno,” he stressed.

Roxas, who is Co-Chairman of the Joint Senate Panel investigating the botched ZTE-NBN deal, said the Senate will continue on with its hearing in the interest of the truth, despite a chorus from the Palace calling for its abortion. He also said that former NEDA Director General Romulo Neri is key to this search for truth.

“Neri is a very important important component in the story. Siya mismo ang nagsabi sa Pangulo na may bribe attempt sa kanya. At kung anuman ang sinagot sa kanya ng Pangulo ay siya rin ang makakapagsabi niyan,” he said.

“What we want to know is first, what were the anomalies here, who perpetuated them and cases should be filed against them. Second, how can we amend our procurement laws para hindi na maulit itong gawain na ito,” he stressed.

Sen. Roxas to arrive at Davao City tomorrow

Senator Mar Roxas will be arriving at Davao City tomorrow Wednesday, to attend the 1st League of Municipalities in the Philippines (LMP) Mindanao Island Cluster Congress.

He praised the LMP for its efforts in furthering unity and progress in Mindanao, noting how its programs reflected “Unity Amidst Diversity Towards Genuine Peace, Progress and Countryside Development,” which is the theme of the event to be held at the Grand Regal Hotel in Lanang, Davao City.

Roxas, keynote speaker for the event, said “It is about time that we change the perception that national development primarily presides in Manila. We have begun our efforts as early as 1991 with the Local Government Code, but our industries in the countryside remain hampered, due in part to the lack of sustainability of peace and order.”

“I believe that our provinces have a lot to gain, and have a lot to contribute, as a result of a peaceful environment,” he added.

Ramon Abalos, mayor of Lambayong, Sultan Kudarat and President of the LMP, is organizing the event, to be attended by about 40 other municipal mayors of Mindanao. Also invited are President Gloria Macapagal Arroyo and Cabinet members.

Roxas, the Liberal Party President, said the LMP would have a lot to gain as well from listening to what their constituents had to say.

“It is important to get the pulse of the people, and learn from them what their needs are, and how local officials can help in this regard,” he said, noting that he has already held talks with some leaders on initiating a Visayas-Mindanao Development Agenda.

“By holding consultations, we can find out what industries need the most attention, and devise a comprehensive plan that would make the most of what we have, and create new wealth and value for each constituency,” he said.

Sen. Mar Roxas on Vis-Min agenda

Senator Mar Roxas and local government executives of key cities in Visayas and Mindanao took the initiative for a Visayas and Mindanao development agenda, which has been neglected in the national development plan.

Roxas, together with Mayor Rodrigo Duterte of Davao City, Mayor Tomas Osmeña of Cebu City, Mayor Jonas Cortes of Mandaue City and Vice-Mayor Dungkoy Emano of Cagayan de Oro City, announced the beginning of consultations to formulate a focused and sustainable plan and “checklist” for the people of Visayas and Mindanao, reported the Philippine News Agency.

“Visayas and Mindanao has a lot to offer our national development, which makes it imperative that these two regions get a fair share of these developments,” Roxas said.

The senator announced that the first salvo of consultations for this development plan will happen in December in Cebu City, with Osmeña’s efforts to conduct consultations with all sectors on two key questions: What they want Cebu to be after 10 years, and what obstacles are there to achieving this goal? This will eventually be rolled-out to other communities in Visayas and Mindanao.
